I am so pleased you have decided to take part in my class - please read the following important terms and conditions before you commit to taking part. These terms will apply to any of my classes in which you participate in the future.
These terms set out:
your legal rights and responsibilities;
my legal rights and responsibilities;
certain key information required by law; and
useful information about the practical side of my class.
They are here to bring clarity and protect both of us so that we can get on with the good stuff! Please take a few moments to read through them and let me know if there is anything you don't understand or would like me to explain. My aim is always to create a welcoming, supportive and inclusive environment where everyone feels comfortable taking part in a way that best suits their needs. As I care about and have high standards regarding the level of service I provide, I place a strict limit on the number of places available in my class. Once those places have been filled, I do not permit anyone else to join. If you sign up to a bundle or course of classes, you confirm your commitment to the entire bundle or course and you will be responsible for payment in full of the price of the bundle or course and you will not be entitled to any refunds.
In this contract:
‘I,’ ‘me’ or ‘my’ means Rebecca Jones of 25 Knightcott, Banwell, BS29 6HS; and
‘You’ or ‘your’ means the person signing up for my class.
Your health
I am not a medical professional and cannot advise on whether you should join the classes or not. If you have any concerns at all about your health and undertaking the classes, you should consult your doctor or other medical professional.
You should notify me at the outset of any medical conditions that you have or any concerns that you have about participating in the classes. If I have concerns about your health and/or ability to participate in the classes, I may require you to leave the class.
Physical exercise disclaimer: You agree that you are voluntarily participating in the classes with the risk that there may be personal injury or illness arising from such participation.
All suggestions and comments I make regarding poses, moves and instruction are not required to be performed by you and are carried out at your election.
You understand that it is your responsibility to judge your physical and mental capabilities for the activities in the classes. It is your responsibility to ensure that you will not exceed your limits while performing such activity, and you will select the appropriate level of activity for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time I may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.
I may ask you to complete a questionnaire before you take part in your first class. It is very important that you answer these questions honestly and completely as these answers will be the foundation for our classes.
Class Guidelines
To help create a comfortable and welcoming environment for everyone, please:
Arrive a few minutes before class starts where possible.
Wear comfortable clothing that allows you to move freely.
Bring a bottle of water and any cushions or supports that will help you feel comfortable.
Work within your own capacity and follow any safety instructions given during class.
Ask if you are unsure about any instruction or would like clarification.
Keep mobile phones on silent and avoid using them during class.
Refrain from smoking on the premises.
Do not attend class under the influence of alcohol or recreational drugs.
Only bring assistance dogs into class.
Be respectful of others and avoid behaviour that disrupts the class or other activities taking place at the venue.
Classes and cancellations
My classes are scheduled for either 45 or 60 minutes. The classes will take place at the times set out in the schedule on my website or social media. I reserve the right to change my scheduled classes and venues and will provide you with as much notice as possible. I also reserve the right to change the instructor of the class without any notice to you. Please ensure that your email address and other contact details are up to date and email me at [email protected] if you need to provide me with updated details.
If you need to cancel a class, please do so by providing as much notice as possible and ideally at least 24 hours’ notice. You must give me this notice by emailing me at [email protected] or for in person classes via my mobile number given at sign up and also found in the class group WhatsApp.
If you have paid for a class in advance and you provide less than 24 hours’ notice of cancellation or miss a class without providing any notice, at my discretion, you may be charged the full payment for that class and will then not be entitled to a refund.
Although the Consumer Protection (Distance Selling) Regulations 2000 (“Regulations”) may apply to the provision of services provided under this agreement, you agree that I may commence the performance of the services before the end of the 14 day cancellation period referred to in the Regulations. If I have already started to provide the services by the time you cancel the agreement, you agree to pay me any costs I have reasonably incurred in starting to perform the services. If you cancel this agreement in the 14 day cancellation period and I have not commenced performance of the services and you have made any payment in advance for services that have not been provided to you, I will refund these amounts to you.
Any place in my classes is subject to availability. Places are allocated on a first-come-first-served basis.
Fees and payments
Class fees are payable in advance of the class.
If you sign up for blocks of classes in advance, I may require that these blocks of classes be taken within a certain period of time or they will expire and I shall not be obliged to provide you with a refund.
If a carer is accompanying you, their place at the class will not be charged but it will need to be booked in advance. The number of such places available at each class is limited.
Third party venues
I hold my classes at venues owned by third parties. You agree to comply with their rules and policies, especially in relation to Health and Safety and fire regulations.
If you bring your personal belongings to classes, you are responsible for their safety and I shall not be liable for any loss, damage or destruction to such belongings.
Data Protection
I comply with data protection laws in relation to your personal data. Please see my privacy policy for details of how I use your personal data.
Intellectual Property
If I provide you with any materials, whether digital or printed, any intellectual property in those materials belongs to me and unless we agree otherwise you can only use those materials for your own personal use and you may not share them with third parties.
You may not without my prior written consent make any audio and/or visual recordings of all or any part of the classes. I may make audio and/or visual recordings of my classes with your permission. You consent to my using any such recordings for marketing purposes and agree that no royalties shall be payable for such use.
Liability – please read this section carefully
Except for any legal responsibility that I cannot exclude in law (such as for death or personal injury caused by negligence), I am not legally responsible for any:
(i)losses that:
(a) were not foreseeable to you and me when this contract was formed which means any losses that might have been sustained by you that would not ordinarily be sustained by a client taking part in similar classes;
(b) that were not caused by any breach of these terms on my part; and
(ii) business losses, including loss of business, business interruption, loss of profits, loss of management time and loss of business opportunity.
My total liability to you is limited to the amount of fees paid by you for the classes and you confirm your understanding that the price of my services is calculated bearing in mind this limit on my liability.
If I am prevented from or delayed in performing my obligations by your act or omission or by any circumstance outside of my control, I shall not be liable to you for any costs, charges or losses sustained or incurred by you that arise directly or indirectly from such prevention or delay.
Disputes
I shall try to resolve any disputes with you quickly and efficiently.
If you and I cannot resolve a dispute using my internal complaint handling procedure and either of us want to take court proceedings, the relevant courts of England and Wales will have exclusive jurisdiction in relation to this contract.
The laws of England and Wales will apply to this contract.
